Regulations

§1. Definitions

• „Regulations” – this document;
• „Website” – the website located at https://goldenauto.es/, including all its subpages;
• „Privacy Policy” – the privacy policy of the Website, available under the „Privacy Policy” tab;
• „Service Provider” – GOLDENBIZNES SP. Z O.O., head office at ul. Złota 7/28, 00‑019 Warsaw, Poland, NIP 5253012183, branch office: CALLE ALFONSO X EL SAVI 12 PUERTA A, 03140 Guardamar del Segura, Spain, CIF N0360454C;
• „Customer Service Office” – the unit of the Service Provider that handles User support under the Regulations; contact available via email info@goldenauto.es, 24/7/365;
• „User” – any adult natural person, legal entity or organizational unit without legal personality, but authorized to acquire rights and obligations in its own name, who uses the Website or Service;
• „Client” – a User who makes a vehicle reservation;
• „Consumer” – a natural person entering into a legal transaction with the Service Provider outside their business or professional activity;
• „Service” – any service offered by the Service Provider;
• „Newsletter” – free informational bulletin of the Website that the User may subscribe to via email.

§ 2. General provisions

1. The Website is operated by the Service Provider.
2. These Regulations define the terms of use of the Website, the type and scope of Services (including electronic services), vehicle reservation conditions, contract formation, execution and termination, complaint handling, dispute resolution and personal data protection rules.
3. The Regulations are available under the „Regulations” tab and may be saved or printed by the User at any time. Upon request, the Service Provider will also provide the Regulations in an electronic file.
4. Users must abstain from unlawful actions, including providing illegal content or interfering with Website operation.
5. The Service Provider offers electronic Services, including account registration, contact and reservation forms.
6. The Provider applies adequate technical and organizational measures to secure communication and data, including prevention of unauthorized access or modification of personal data.

§ 3. Technical Requirements

Users must have:

• a computer or other Internet-enabled device;
• an operating system compatible with a web browser;
• a browser accepting cookies;
• an email address for account registration or reservation.

§ 4. Website Content

1. Prices are displayed in EUR and exclude VAT.
2. Vehicle types, features and rental fees are described on the Website.

§ 5. Account Registration and Login

1. Registration is voluntary, free and required to make a reservation.
2. Account registration creates a user profile enabling future form auto-filling. Legal basis: service contract. Required data must be provided to register and conclude the contract. Data retention: service duration plus statute of limitation.
3. Users must accept the Regulations and Privacy Policy via checkbox.
4. Login requires email and password, which the User must keep confidential and update regularly.
5. Users may delete their account at any time without notice, by contacting the Service Provider in writing or via Customer Service email.

§ 6. Vehicle Reservation

1. Reservations depend on vehicle availability and are handled by Customer Service.
2. After login, the Client selects a vehicle and completes the reservation process via prompts.
3. Required reservation data must be provided; legal basis: Client’s consent. Data retention: until reservation confirmed or consent withdrawn.
4. Reservation becomes valid when confirmed via email by the Provider.
5. The rental agreement is concluded at the rental start date via separate written declarations. Final payment is due before vehicle pick-up.

§ 7. Cancellation and Amendment of Reservation

To cancel or amend reservation details, Clients must contact Customer Service. The Provider may retain deposits if reservation is canceled.

§ 8. Payment

Clients may pay via:

§ 9. Consumer Right of Withdrawal (Distance/Premises Contracts)

Consumers may withdraw within 14 days without cause or charge. The period runs from contract conclusion. Withdrawal requires a statement before the deadline and can be sent electronically. On withdrawal, the contract is void; the Provider refunds payments within 14 days via the original method, unless another cost-free method is agreed. Supplementary contracts expire upon withdrawal, without cost to Consumer. Withdrawal does not apply to:

• fully executed services with Consumer’s consent;
• price subject to financial market fluctuations;
• custom-made goods;
• urgent repair/maintenance visits;
• auction contracts;
• services related to accommodation, transport, car rental, catering, leisure, sports, entertainment, if time defined.

Legal basis: fulfillment of legal obligations. Required data must be provided. Data retention: period needed to comply with legal obligations and beyond to cover limitation periods.

§ 10. Complaints Regarding Services

Complaints must be submitted in writing or via email to Customer Service, stating name, address and complaint subject. Provider responds within 14 days. Data processing legal basis: legal obligation. Required data: voluntary but essential for complaint processing. Data retention: for complaint processing duration plus limitation periods.

§ 11. Social Media Profiles

The Provider manages social media profiles to publish information or promotions. Profiles allow user-posted content as per platform rules. Profile use is free and indefinite. Users may unsubscribe anytime. Data required by the platform is mandatory. Data retention: as long as User is active; posted content remains until deletion. Platform’s terms apply.

§ 12. Personal Data Protection

The Provider is the data controller. Data recipients include IT service providers, platform operators, payment processors, rental point operators, postal/courier services, office, accounting, marketing or legal service providers. If processing is based on consent, it can be withdrawn anytime without affecting prior processing. Data subjects can request access, rectification, deletion, restriction, portability or lodge complaints with supervisory authorities (written or via email).

Detailed purposes, legal basis, required data and retention periods are set out in sections concerning respective data categories.

§ 13. Out-of-Court Dispute Resolution (Consumers)

Consumers may:

• apply to the regional Inspectorate of Trade Inspection for mediation (Art. 36 of Trade Inspection Act);
• apply to a permanent consumer arbitration court at the regional Inspectorate (Art. 37).

§ 14. Final Provisions

1. Provisions are interpreted under applicable law and consumer rights remain protected.
2. Legal sources: Polish Civil Code, Act on Consumer Rights, Act on Electronic Services.
3. Provider may amend Regulations due to legal changes, errors, contact info, service functionality, or technical conditions.
4. Amendments take effect 14 days after publication, with at least 14-day notice to registered users and Newsletter subscribers.
5. Users may refuse amendments by deleting their account or unsubscribing.
6. Changes do not apply to reservations made before their effective date.
7. These Regulations are effective from 1 July 2025.
